DMCA Takedown Procedure

1. Overview

Aksoy Capital respects the intellectual property rights of others and complies with the Digital Millennium Copyright Act (DMCA) and applicable copyright laws.

If you believe content on aksoycapital.com infringes your copyright, please follow the procedure below.

2. Filing a DMCA Notice

To file a takedown notice, send a written communication including all of the following:

Identification of the copyrighted work — describe the work you claim has been infringed.
Identification of the infringing material — provide the exact URL on aksoycapital.com.
Your contact information — name, mailing address, telephone, email.
Good-faith statement — "I have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law."
Accuracy statement under penalty of perjury — "I swear, under penalty of perjury, that the information in this notification is accurate and that I am the copyright owner or am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed."
Physical or electronic signature of the copyright owner or authorized agent.

3. Counter-Notification

If your content was removed and you believe the removal was in error or due to misidentification, you may file a counter-notification with:

Your physical or electronic signature.
Identification of the removed material and its location before removal.
Statement under penalty of perjury that you have a good faith belief the material was removed by mistake or misidentification.
Your name, address, phone, and consent to the jurisdiction of the federal court in your district (or any judicial district in which Aksoy Capital may be found if outside the US).

4. Response Time

Aksoy Capital will:

Acknowledge valid DMCA notices within 2 business days
Remove or disable access to allegedly infringing material expeditiously
Notify the affected user if their content is removed
Restore content if a valid counter-notification is received and the original notifier does not file a court action within 10-14 business days

5. Repeat Infringers

Accounts subject to multiple substantiated infringement claims will be terminated in accordance with Aksoy Capital's repeat infringer policy.

6. False Claims

Material misrepresentation in a DMCA notice or counter-notification may subject the filer to liability for damages under 17 U.S.C. § 512(f).
